释义	关于民事权利能力和民事行为能力问题公民的民事权利能力自出生时开始。出生的时间以户籍为准没有户籍证明的，以医院出具的出生证明为准，没有医院证明的，参照其他有关证明认定。关于职工退休年龄的政策规定劳动保障部《关于制止和纠正违反国家规定办理企业职工提前退休有关问题的通知》(劳动部发amplt1999ampgt8号)第二条第二项规定：对职工出生时间的认定，实行居民身份证与职工档案相结合的办法，当本人身份证与档案记载的出生时间不一致时，以本人档案最先记载的出生时间为准。
