问题	什么是侵犯商标权
释义	行为人销售明知或应知是假冒注册商标的商品，商标专用权被侵权的自然人或者法人在民事上有权要求侵权人停止侵害、消除影响、赔偿损失。承担赔偿的责任行为是要承担赔偿的责任的，侵权人通常需承担停止侵权的责任，明知或应知是侵权的行为人还要承担赔偿的责任。情节严重的，还要承担刑事责任，我国《刑法》有专门针对知识产权犯罪的规定。法律依据：《最高人民法院、最高人民检察院关于办理侵犯知识产权刑事案件具体应用法律若干问题的解释》（二）第三条
