二轮摩托撞伤人怎么办 |

2009年8月14日早晨6点半我骑二轮摩托正方向行使去上班的路上在十字路口斑马线处撞上了一个老人。当时我的车速在40到50，老人想横过马路，在大概相隔30米的距离时我按了喇叭，可老人看了我一眼后又继续过马路，我就想从老人前面绕过去可刚好有一辆摩托车从我的有边超我的车，这时我的车离老人已经很近了，我在没办法改变方向的情况下急忙刹车，由于惯性我的车翻倒撞倒了老人.我叫来了救护车把老人送上车后就随交警到交警大队。老人71岁，脚骨撞裂一处，肋骨撞裂一处。医生说可以上石膏。老人的家属要求我赔偿3万元是否合理?

你的车应有强制险，由保险公司赔偿即可。

保险公司在与被保险人之间保险合同成立后，就同一事实又与学校签订保险合同，该合同对被保险人不具有约束力。未成年人本应以其父母作为投保人，但是学校未经学生家长同意就以投保人名义代学生订立保险合同的代理行为，属无权代理，事后未经学生家长追认，应认定为无效民事行为。保险公司在“致学生家长的一封信”中并没有“无证驾驶属其责任免赔条款”，也未向危某家长即投保人明确说明保险人责任免除条款。所以依照保险法的规定，保险公司应履行其在“致学生家长的一封信”中的承诺，承担给付6.6万元保险金的赔偿责任。
