法律分析：喝酒出车祸一起喝酒的不一定需要承担责任，如果发生以下情况，则共同饮酒人也应承担相应的赔偿责任：不存在下列情况的，则同桌喝酒的人不承担责任：
1、强迫性劝酒。
2、未将醉酒者安全护送，如饮酒者已失去或即将失去对自己的控制能力，神志不清无法支配自身行为时，酒友没有将其送至医院或安全送回家中。
3、酒后驾车未劝阻导致发生车祸等损害的。
一、酒驾同桌喝酒的人有什么责任
和人一起喝酒中，如果饮酒出事，有四种情况劝酒者需承担法律责任：
1、强迫性劝酒，比如用不喝不够朋友等语言刺激对方喝酒，或在对方已喝醉意识不清没有自制力的情况下，仍劝其喝酒的行为；
2、明知对方不能喝酒仍劝其饮酒，比如明知对方身体状况，仍劝其饮酒诱发疾病等；
3、未将醉酒者安全护送，如饮酒者已失去或即将失去对自己的控制能力，神志不清无法支配自身行为时，酒友没有将其送至医院或安全送回家中；
4、酒后驾车未劝阻导致发生车祸等损害的。
二、酒桌喝酒旁人是否有责任
酒桌喝酒如果他人极力劝酒导致受害人伤亡的，极力劝酒的同饮人是有责任的，可能要承担民事赔偿的责任。另外，如果明知对方不能喝酒仍劝其饮酒、在明知对方醉酒的情况下未将醉酒者安全护送回家或者酒后驾车未劝阻导致发生车祸等损害的，一般一同饮酒的人是有责任的。
法律依据：《中华人民共和国民法典》
第一千一百六十五条行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。
依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
