释义	法律分析：驱逐出境是强迫犯罪的外国人离开中国国（边）境的刑罚方法。《刑法》第35条规定：“对于犯罪的外国人，可以独立适用或者附加适用驱逐出境。”由于驱逐出境既可以独立适用也可以附加适用，故符合附加刑的基本特征；由于驱逐出境仅适用于犯罪的外国人（包括具有外国国籍与无国籍的人），故是一种特殊的附加刑。由于刑法中的驱逐出境是附加刑，故其与《外国人入境出境管理法》规定的由公安机关决定、适用于违反出入境管理法的外国人、作为行政处罚的驱逐出境具有本质区别。
