释义	法律分析：一般情况下，民间房屋抵押贷款是合法的，但是必须要在法律允许的范围内，否则法律是不会保护该抵押行为的。抵押行为只是债务实现的其中一种手段，民间借贷合法并不意味着抵押权就一定会生效。当事人要进行抵押登记才能生效。办完抵押登记后才能享有抵押权，不用办抵押登记的，要签订抵押合同。法律依据：《中华人民共和国民法典》第四百零二条以本法第三百九十五条第一款第一项至第三项规定的财产或者第五项规定的正在建造的建筑物抵押的，应当办理抵押登记。抵押权自登记时设立。
