释义	法律分析: 过错推定原则，也叫过失推定，在侵权行为法上，就是受害人在诉讼中，能证明违法行为与损害事实之间的因果关系的情况下，如果加害人不能证明损害的发生自己无过错，那么就从损害事实的本身推定被告在致人损害、致物损失的行为中有过错，并为此承担赔偿责任。【法律依据】: 《中华人民共和国民法典》第一千一百六十五条行为人因过错侵害他人民事权益造成损害的,应当承担侵权责任。依照法律规定推定行为人有过错,其不能证明自己没有过错的,应当承担侵权责任。
