释义	法律分析：公司正常营运的状态下公司法人能当担保人的。担保人需要拥有的资质为：与本案无牵连;享有政治权利，人身自由未受到限制;在当地有常住户口和固定住所;有能力履行担保义务;没有明显的违约记录的资质的人才具有担当担保人即保证人的资质。法律依据：《中华人民共和国民法典》第六百八十三条机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人、非法人组织不得为保证人。
