法律分析：1.合同本身的法律性质不同：聘用合同调整的是政府对公共组织及其工作人员的人事管理行为和工作人员行为规范，属于公法调整范畴。而劳动合同规范的是企业与劳动者之间的劳动关系，属于私法调整范畴。2.合同主体的权利义务关系不同：企业的劳动合同是纯粹的民事合同，合同中所规定的权利与义务对当事人来讲基本上是平等的。民事合同强调契约的自由性、合意性，一般不会发生不确定的权利或义务关系，即使发生，双方均可自由协调解决，解除合同。
法律依据：《中华人民共和国劳动合同法》
第三条 订立劳动合同，应当遵循合法、公平、平等自愿、协商一致、诚实信用的原则。依法订立的劳动合同具有约束力，用人单位与劳动者应当履行劳动合同约定的义务。
第十条 建立劳动关系，应当订立书面劳动合同。已建立劳动关系，未同时订立书面劳动合同的，应当自用工之日起一个月内订立书面劳动合同。用人单位与劳动者在用工前订立劳动合同的，劳动关系自用工之日起建立。
第三十六条 用人单位与劳动者协商一致，可以解除劳动合同。
