二、谁有权决定逮捕
我国《宪法》第37条规定：任何公民，非经人民检察院批准或者决定或者人民法院决定，并由公安机关执行，不受逮捕。逮捕犯罪嫌疑人、被告人，必须经过人民检察院批准或者人民法院决定，由公安机关执行。
逮捕权由公、检、法机关行使，其他任何机关、团体和个人都无权行使。在公、检、法机关之间，逮捕的权限是不同的，具有一定的分工。人民检察院和人民法院有权决定逮捕，人民检察院具有批准逮捕权，公安机关对自己侦查的案件，认为需要逮捕犯罪嫌疑人的时候，应当依法提请人民检察院审查批准，它无权自行逮捕。
无论是决定逮捕还是批准逮捕，都由公安机关执行。
三、法律依据：《刑事诉讼法》
第八十五条公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
第八十七条人民检察院审查批准逮捕犯罪嫌疑人由检察长决定。重大案件应当提交检察委员会讨论决定。
