释义	法律分析: 是可以交的。法律依据: 《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》第二条出卖人未取得商品房预售许可证明，与买受人订立的商品房预售合同，应当认定无效，但是在起诉前取得商品房预售许可证明的，可以认定有效。该规定中关于商品房预售合同无效的情形，仅指自始未取得商品房预售许可证，这与商品房预售许可证过了有效期有本质区别。出卖人取得预售许可证即具有预售资格，不应因预售许可证的过期而丧失预售资格。因此，预售许可证过期后签订的商品房买卖合同应当认定为有效。
