释义	法律分析：违约金不是破产债权，破产债权的申报应当以实际发生的损失来计算，而违约金不能计算在实际损失当中。破产债权，是指在破产宣告前成立的，对破产人发生的，依法申报确认并得由破产财产中获得公平清偿的财产请求权。法律依据：《中华人民共和国企业破产法》第四十五条人民法院受理破产申请后，应当确定债权人申报债权的期限。债权申报期限自人民法院发布受理破产申请公告之日起计算，最短不得少于三十日，最长不得超过三个月。
