释义	法律分析: 优先级，一般叫法律渊源的位阶。在上一位阶法律规范已有规定的情况下，下一位阶的法律规范不得与上一位阶的法律规范抵触；上一位阶法律规范没有规定，下一位阶法律规范作了规定的，一旦上一位阶法律规范就该事项作出规定，下一位阶法律规范就必须服从上一位阶法律规范。法律依据: 《中华人民共和国立法法》第八十七条宪法具有最高的法律效力，一切法律、行政法规、地方性法规、自治条例和单行条例、规章都不得同宪法相抵触。
