释义	质保金是工程总造价的5%，一般工程都依据此比例执行。在质保期内，施工单位有对所建工程维修的义务，如果不尽此义务，那么建设单位可以另找他人进行维修，所需费用从质保金中扣除。剩余部分在质保期结束后，建设单位必须支付。 2005年1月建设部、财政部发布的《建设工程质量保证金管理暂行机制》规定，建设工程质量保证金(保修金)(以下简称保证金)是指发包人与承包人在建设工程承包合同中约定，从应付的工程款中预留，用以保证承包人在缺陷责任期内对建设工程出现的缺陷进行维修的资金。
