释义	生父母中有一方不同意的，收养关系不能成立。生父或生母送养时，另一方明知而不表示反对的，应视为同意。养父母中有一方在收养时虽未明确表示同意，但在收养后的长期共同生活中，已形成了事实上收养关系的，应予承认。夫或妻一方收养的子女，另一方始终不同意的，无效。法律依据《民法典》第一千零九十七条
