释义	法律分析：如果当事人不知道已婚者已婚，以夫妻名义居住而生孩子的，当事人不属于重婚罪。但如果明知对方有配偶，双方以夫妻关系共同生活并生下小孩的，构成重婚罪，处二年以下有期徒刑或者拘役。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
