释义	行政处罚适用法条竞合，如果一项行为触犯了不同的行政法规的，只能给予一次处罚，当事人不服的，可以提起行政复议。对于处罚主体的冲突，只能按照适用特别法的行政主体优于适用普通法的行政主体的原则，由前者予以处罚;对于法律条款的冲突，依据上位法优于下位法、后法优于前法、特别法优于普通法、特别条款优于普通条款的原则予以解决。法律依据：《中华人民共和国行政处罚法》第二十四条规定对当事人同一个违法行为，不得给予两次以上罚款的行政处罚
