释义	《中华人民共和国刑法》第三百一十三条规定： 1、不可以，通常借钱不还这样的事件属于民事纠纷，没有上升到刑事层面。法院可以对被的财产进行查封、冻结和扣押，对被执行人进行拘留、罚款，还可以将被执行人列入失信人“黑名单”，限制其高消费。但是如果借款人拒绝执行或是有能力不还，那么法院是可以追求借款人的刑事责任，过分严重的情节就会坐牢。 2、对人民法院的判决、裁定有能力执行而拒不执行，情节严重的，处三年以下有期徒刑、拘役或者罚金。法律依据《中华人民共和国刑法》第三百一十三条
