释义	法律分析：如果行为人在收到投资人本金的同时即已经将利息事先予以扣除的，甚至在收到本金之前即已经预先支付了利息的，则利息应当从犯罪数额中扣除。如果行为人先收取本金，在经过一段时间后才按照约定支付利息，则在这种情况下，支付的利息不应当从犯罪数额中扣除。法律依据：《中华人民共和国民法典》第六百七十条借款的利息不得预先在本金中扣除。利息预先在本金中扣除的，应当按照实际借款数额返还借款并计算利息。
