根据《中华人民共和国道路交通安全法》第五十一条机动车行驶时，驾驶人、乘坐人员应当按规定使用安全带，摩托车驾驶人及乘坐人员应当按规定戴安全头盔。 1、在城市快速路上行驶时，驾驶人未按规定使用安全带的，罚款50元，扣2分; 2、在高速公路或城市快速路以外的道路上行驶时，驾驶人未按规定使用安全带的，罚款50元，不扣分; 3、(城市快速路是指--城市道路中设有中央分隔带，具有四条以上的车道，全部或部分采用立体交叉与控制出入，供车辆以较高的速度行驶的道路);机动车行驶时，乘坐人员未按规定使用安全带的，罚款5元;在高速公路上行驶时，驾驶人未按规定使用安全带的，罚款50元，扣2分; 4、车辆通行高速公路时，乘车人不按规定系安全带的，罚款20元;在城市市区限速50公里以下路段驾驶机动车，乘坐人未按规定使用安全带，经指出后立即改正的，口头 警告 ; 5、当汽车高速行驶遇到意外情况紧急制动时，正确使用安全带可以将驾驶人和乘客束缚在座椅上，避免或减轻碰撞伤害。为督促驾驶人使用安全带，规定对驾驶机动车在高速公路或者城市快速路上行驶时，驾驶人未按规定系安全带的，一次记2分; 6、副驾驶必须佩戴安全带的规定早在旧交规中已经有明确规定。凡是在副驾驶上不佩戴安全带的，执勤交警均可以对乘坐人处以罚款20元的处罚。
