第九十四条用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款;情节严重的，由市场监督管理部门吊销营业执照。
《中华人民共和国未成年人保护法》
第六十八条非法招用未满十六周岁的未成年人，或者招用已满十六周岁的未成年人从事过重、有毒、有害等危害未成年人身心健康的劳动或者危险作业的，由劳动保障部门责令改正，处以罚款;情节严重的，由工商行政管理部门吊销营业执照
