释义	法律分析: 行政诉讼案件实行两审终审制。所谓两审终审制是指案件经过两级人民法院审理才能终结的审判制度。一个行政案件，经人民法院按照第一审程序审理后，如果当事人提起上诉，该行政案件还要由上一级人民法院按照第二审程序进行一次审理，第二审人民法院作出的判决、裁定，才是终审的判决、裁定。法律依据: 《中华人民共和国行政诉讼法》第七条人民法院审理行政案件，依法实行合议、回避、公开审判和两审终审制度。
