释义	法律主观：根据《刑法》的规定，罚金属于附加刑，如果未交纳的，不会影响所判的主刑的执行，主刑服刑期满后，就应该将罪犯予以释放。但未交的罚金可由法院强制执行。《刑事诉讼法》第二百五十三条第五款：判处有期徒刑、拘役的罪犯，执行期满，应当由执行机关发给释放证明书。第二百六十条被判处罚金的罪犯，期满不缴纳的，人民法院应当强制缴纳；如果由于遭遇不能抗拒的灾祸缴纳确实有困难的，可以裁定减少或者免除。
