释义	拾得信用卡并使用的应当构成侵占罪和诈骗罪。所谓拾取信用卡并使用，是指行为人拾取他人遗忘或丢失的真实、合法、有效的信用卡并使用的行为。行为人在特定场所取得他人的信用卡和密码，如果取得他人留在ATM机上的信用卡，无需办理其他手续即可取款，构成侵占罪。行为人在非特定场所取得和使用信用卡时，未经持卡人同意或者授权，冒用他人身份使用信用卡取款、支付、消费，侵犯他人合法权益，符合构成信用卡诈骗罪的法律特征，应当以本罪论处。
