释义	法律分析：一房二卖的当事人应当承担违约责任，出卖人就同一房屋分别签订数份买卖合同，在合同均为有效的前提下，买受人均要求继续履行合同的，按以下顺序确定履行合同的买受人：已经办理房屋所有权转移登记的;均未办理房屋所有权转移登记，已经实际合法占有房屋的。法律依据：《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
