释义	行政复议和行政诉讼不可以同时进行。只有行政复议不认同时才可以起诉，并且复议期间不可以起诉。法律依据：《中华人民共和国行政复议法》第十六条公民、法人或者其他组织申请行政复议，行政复议机关已经依法受理的，或者法律、法规规章应当先向行政复议机关申请行政复议、对行政复议决定不服再向人民法院提起行政诉讼的，在法定行政复议期限内不得向人民法院提起行政诉讼。公民、法人或者其他组织向人民法院提起行政诉讼，人民法院已经依法受理的，不得申请行政复议。
