问题	我国刑法对强奸罪的立案规定?
释义	有下列两种情形之一的，都应当以强奸罪立案追究：（1）以暴力、胁迫或者其他手段强奸妇女的；（2）奸淫不满14周岁幼女的。强奸罪是行为犯，只要行为人实施了强奸妇女或者奸淫幼女的行为，不论是否达到奸淫的目的，都应当立案追究。法律依据《刑法》第236条
