释义	债务人将合同的义务全部或者部分转移给第三人的，应当经债权人同意。这是目前我国法律关于债务承担的最明确之规定。. 债务承担是债的移转之一种，是指有第三方介入债权债务关系，基于债权人、债务人与第三人之间达成的协议，为原债务人承担一部分或全部债务的法律行为。法律依据:《中华人民共和国民法典》第五百五十二条第三人与债务人约定加入债务并通知债权人，或者第三人向债权人表示愿意加入债务，债权人未在合理期限内明确拒绝的，债权人可以请求第三人在其愿意承担的债务范围内和债务人承担连带债务。
