不能履行合同要怎样办

疫情导致合同义务不能履行的情况可分为合同全部不能履行、合同部分不能履行及合同暂时不能履行三种，对合同全部不能履行的，当事人应按照《合同法》的规定：1、及时以书面方式通知对方解除合同，合同自通知到达对方时解除，或由当事人协商一致解除合同。2、被通知一方如有异议，应在收到解除通知之日起三个月内向法院起诉主张异议。3、对合同部分不能履行或暂时不能履行的，当事人可协商变更合同，约定延期履行或部分履行。
