释义	法律分析：劳动合同到期后，用人单位既未终止劳动合同，也未续签订劳动合同，劳动者继续在用人单位工作，实际上双方建立了事实劳动关系。根据劳动部《关于实行劳动合同制度若干问题的通知》规定，有固定期限的劳动合同期满后，因用人单位方面的原因未办理终止或续签订手续而形成事实劳动关系的，视为续签订劳动合同。法律依据：《劳动合同法实施条例》第十七条劳动合同期满，但是用人单位与劳动者依照劳动合同法第二十二条的规定约定的服务期尚未到期的，劳动合同应当续延至服务期满;双方另有约定的，从其约定。
