存储柴油不卖违法吗

释义

法律主观：

非法存储柴油应当受到的处罚为处十日以上十五日以下拘留；情节较轻的，处五日以上十日以下拘留。这是行政违法行为。但是若储存柴油是用于贩卖，金额达到五万元以上还会构成非法经营罪。

法律客观：

《中华人民共和国治安管理处罚法》第三十条违反国家规定，制造、买卖、储存、运输、邮寄、携带、使用、提供、处置爆炸性、毒害性、放射性、腐蚀性物质或者传染病病原体等危险物质的，处十日以上十五日以下拘留；情节较轻的，处五日以上十日以下拘留。
