释义	生效条件如下：1.所赠财物必须是属于赠与人自己所有的合法财物。2.内容必须是赠与人自身意志的真实表示。3.受赠人愿意接受赠与的真实意思表示。如果受赠与人不愿意接受赠与，或者受赠与人愿意接受赠与，而赠与人没有赠与的意思，则赠与合同不成立。【法律依据】《合同法》第192条，受赠人有下列情形之一的，赠与人可以撤销赠与：（一）严重侵害赠与人或者赠与人的近亲属；（二）对赠与人有扶养义务而不履行；（三）不履行赠与合同约定的义务。赠与人的撤销权，自知道或者应当知道撤销原因之日起一年内行使。
