释义	法律分析: 专利权在先申请原则是先发明原则的对称。两个以上的申请人分别就同样的发明创造申请专利的，专利权授予最先申请的人的原则。同样内容的发明创造，在一国领土范围内只能授予一个专利权，或者给予发明在先的人，或者给予申请在先的人，多数国家在这种情况下，专利权授与申请在先的人。法律依据: 《中华人民共和国专利法》第三条国务院专利行政部门负责管理全国的专利工作一受理和审查专利申请，依法授予专利权。省、自治区、直辖市人民政府管理专利工作的部门负责本行政区域内的专利管理工作。
