释义	法律分析: 同居两年以上不一定算事实婚姻，民法上的认定和刑罚不同，民法中认为男女双方虽具备结婚实质要件但欠缺形式要件未进行结婚登记的，则应按同居关系处理。刑法上更为严格，如果在同居期间是以夫妻名义而同居的，则会构成事实婚姻，而构成事实上的婚姻，又是有配偶的人的话，还会涉嫌重婚罪。法律依据: 《中华人民共和国民法典》第一千零四十九条要求结婚的男女双方应当亲自到婚姻登记机关申请结婚登记。符合本法规定的，予以登记，发给结婚证。完成结婚登记，即确立婚姻关系。未办理结婚登记的，应当补办登记。
