释义	法律分析：所谓公诉案件，亦即刑事公诉案件，是指由各级检察机关依照法律相关规定，代表国家追究被告人的刑事责任而提起诉讼的案件。法律依据：《中华人民共和国刑事诉讼法》第一百三十六条凡需要提起公诉的案件，一律由人民检察院审查决定。第一百三十七条人民检察院审查案件的时候，必须查明：（一）犯罪事实、情节是否清楚，证据是否确实、充分，犯罪性质和罪名的认定是否正确；（二）有无遗漏罪行和其他应当追究刑事责任的人；（三）是否属于不应追究刑事责任的；（四）有无附带民事诉讼；（五）侦查活动是否合法。
