释义	缓刑称暂缓量刑，也称为缓量刑，是指对触犯刑律，经法定程序确认已构成犯罪、应受刑罚处罚的行为人，先行宣告定罪，暂不执行所判处的刑罚。由特定的考察机构在一定的考验期限内对罪犯进行考察，并根据罪犯在考验期间内的表现，依法决定是否适用具体刑罚的一种制度。缓刑是不可以申请的。根据我国刑法的规定，缓刑适用于以下几种条件都满足的情况： 1、原判刑罚是拘役或3年以下有期徒刑； 2、犯罪人不是累犯； 3、根据犯罪人的犯罪情节和悔罪表现，适用缓刑确实不旨再危害社会。
