释义	根据《施工合同司法解释(二)》相关规定，对于在起诉前双方已经完成工程结算并且对建设工程价款达成结算协议的，以及工程合同约定固定造价的，在法院起诉阶段，甲方都无权申请进行工程造价坚定。造价鉴定的目的是确实欠款事实，既然双方对欠款工程的事实都没有异议，甲方申请鉴定就没有必要了。
