释义	并不是一方婚内出轨的就必须净身出户，法律没有这种规定。除非出轨一方自愿放弃夫妻共同财产的分割，否则出轨方是不会净身出户的。即使是出轨一方构成重婚或者与他人同居的过错情形的，法院在判决财产分割时会照顾无过错的一方的情况下，出轨方也不会净身出户一点财产都分不到。【法律依据】《民法典》第一千零八十七条，离婚时，夫妻的共同财产由双方协议处理；协议不成的，由人民法院根据财产的具体情况，按照照顾子女、女方和无过错方权益的原则判决。对夫或者妻在家庭土地承包经营中享有的权益等，应当依法予以保护。
