释义	一般说来，在法律条文中，“可以”与“应当”是具有明显区别的。所谓“可以”，是授权性规定，基本上“可以”等同于“有权”怎样做；所谓“应当”，是义务性规定，是法定的必须如此；是命令性的指引要求，要求人们“为”一定行为，如果“不为”就是违法，因而具有“强制性”。法律依据：《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
