释义	公司不签劳动合同，可以到劳动监察大队举报投诉。劳动纠纷只能先仲裁，对仲裁结果不服再起诉，直接起诉法院是不受理的。劳动仲裁的结果对诉讼没有影响。没有劳动合同，要提供能证明和单位存在劳动关系的证据，比如工资卡、出勤卡之类。没有劳动合同，在单位工作不超过一年的，可以要求从入职第二个月起的双倍工资补偿。超过一年的视为无固定期限合同。法律依据：《劳动争议调解仲裁法》第八十二条用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。
