问题	婚后一方债务要不要共同承担
释义	婚姻中的一方债务不需要共同承担，债权人能够证明债务用于家庭共同生活的除外。债权人就一方婚前所负个人债务向债务人的配偶主张权利的，人民法院不予支持。但债权人能够证明所负债务用于婚后家庭共同生活的除外。【法律依据】《最高人民法院关于适用〈中华人民共和国民法典〉婚姻家庭编的解释（一）》第三十四条，夫妻一方与第三人串通，虚构债务，第三人主张该债务为夫妻共同债务的，人民法院不予支持。夫妻一方在从事赌博、吸毒等违法犯罪活动中所负债务，第三人主张该债务为夫妻共同债务的，人民法院不予支持。
