释义	女军人出轨女军人不构成破坏军婚，破坏军婚是指非军人破坏军人的婚姻。但是如果女军人的配偶也是军人的，而女军人出轨对象不是军人的，则第三者会构成破坏军婚。构成破坏军婚的，将面临刑事处罚，会处三年以下有期徒刑或者拘役。法律依据《刑法》第二百五十九条，明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。利用职权、从属关系，以胁迫手段奸淫现役军人的妻子的，依照本法第二百三十六条的规定定罪处罚。
