合作医疗急诊门诊给报销吗 |

法律分析：合作医疗急诊门诊费用可以报销，以下情况不列入新型农村合作医疗报销范围：（一）非区内定点医院门诊医疗费用（特殊病种门诊治疗费用除外）、未按规定就医、自购药品所产生的费用;（二）计划生育措施所需的费用，违反计划生育政策的医疗费用;（三）镶牙、口腔正畸、验光配镜、助听器、人工器官、美容治疗、整容和矫形手术、康复性医疗（如气功、按摩、推拿、理疗、磁疗等）以及各类陪客费、就诊交通费、出诊费、住院期间的其他杂费等费用;（四）存在第三方责任的情况下，发生人身伤害产生的医药费依法由第三责任方承担，如交通事故、医疗事故、工伤等;（五）因自杀、自残、服毒、吸毒、打架斗殴等违法行为以及其家属的故意行为造成伤害所产生的医药费;（六）出国或在港、澳、台地区期间发生的医疗费用;（七）城镇职工医疗保险制度规定不予报销的药品和项目;（八）区医管会确定的其他不予报销的费用。

第二十四条 国家建立和完善新型农村合作医疗制度。新型农村合作医疗的管理办法，由国务院规定。
第二十六条 职工基本医疗保险、新型农村合作医疗和城镇居民基本医疗保险的待遇标准按照国家规定执行。
第二十八条 符合基本医疗保险药品目录、诊疗项目、医疗服务设施标准以及急诊、抢救的医疗费用，按照国家规定从基本医疗保险基金中支付。
