释义	刑法修改案（九）第十九条规定，在《刑法》第二百六十条后增加一条，作为第二百六十条之一：对未成年人、老年人、患病的人、残疾人等负有监护、看护职责的人虐待被监护、看护的人，情节恶劣的，处三年以下有期徒刑或者拘役。该规定将虐待被监护人、看护人罪纳入到了刑法中。保姆受托对老人进行看护，本应按照合同约定尽心看护照顾老人，然其却违反法律规定，对被看护人进行虐待，情节恶劣，依法构成虐待罪，应当承担相应的刑事责任。法律依据《中华人民共和国刑法》第二百六十条之一
