法律依据：
《刑法》第三百零七条
以暴力、威胁、贿买等方法阻止证人作证或者指使他人作伪证的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。
帮助当事人毁灭、伪造证据，情节严重的，处三年以下有期徒刑或者拘役。
司法工作人员犯前两款罪的，从重处罚。

帮助毁灭证据罪的构成要件主要有：
1、本罪所侵害的客体是司法机关的正常活动，对象则是当事人；
2、本罪在客观方面表现为帮助当事人毁灭、伪造证据；
3、本罪的主体为年满l6周岁具有刑事责任能力的自然人；
4、本罪的主观方面是故意。
《刑法》第三百零七条 以暴力、威胁、贿买等方法阻止证人作证或者指使他人作伪证的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。
帮助当事人毁灭、伪造证据，情节严重的，处三年以下有期徒刑或者拘役。

帮助毁灭、伪造证据罪的成立条件是：1、侵害的客体是司法机关的正常活动。2、在客观方面表现为帮助当事人毁灭、伪造证据的行为。3、行为人是年满16周岁具有刑事责任能力的自然人。4、在主观方面是故意。
