释义	法律分析: 申请工伤鉴定首先必须要工伤认定。用人单位、工伤职工本人或其直系亲属、工会组织都有权向用人单位工伤保险统筹地区劳动保障行政部门提出工伤认定申请、登记，并领取《工伤认定申请表》等有关须知和材料。法律依据: 《工伤职工劳动能力鉴定管理办法》第七条职工发生工伤，经治疗伤情相对稳定后存在残疾、影响劳动能力的，或者停工留薪期满(含劳动能力鉴定委员会确认的延长期限)，工伤职工或者其用人单位应当及时向设区的市级劳动能力鉴定委员会提出劳动能力鉴定申请。
