释义	保证金一般是可以退的。保证金属于担保性质，担保的约定是附属于主合同的。如果主合同的义务履行了，那么担保期间的担保责任就可以免除，保证金应当予以退还。合同保证金，一般是在双方都基本履行完毕合同内容后才退还的。【法律依据】《民法典》第五百八十七条，债务人履行债务的，定金应当抵作价款或者收回。给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金；收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。
