释义	法律分析: 一般情况下，当事人在一审时陈述的事实，到二审时是有效的，不得随意变更。法律依据: 《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第九十二条一方当事人在法庭审理中，或者在起诉状、答辩状、代理词等书面材料中，对于己不利的事实明确表示承认的，另一方当事人无需举证证明。第三百四十二条当事人在第一审程序中实施的诉讼行为，在第二审程序中对该当事人仍具有拘束力。当事人推翻其在第一审程序中实施的诉讼行为时，人民法院应当责令其说明理由。理由不成立的，不予支持。
