释义	可以，法人没经过股东的同意私自转让公司，针对第三方，如果手续齐备，其行为有效，但法人应承担没经过股东的同意私自转让公司的法律后果。转让手续不齐全或者违规，转让无效。但是为了保护善意第三人、实际出资人的权益，该法定代表人应该对此作出赔偿。《公司法司法解释3》第25条名义股东将登记于其名下的股权转让、质押或者以其他方法处分，实际出资人以其对于股专权享有实际权利为由，请求认定处分股权行为无效的，人民法院可以参照物权法第一百零六条的规章处置。
