夫妻双方一方同性恋能不能离婚吗
释义
夫妻一方与他人保持同性恋关系，事实上与无过错方不存在感情相吸的可能，同性恋一方在思想主观上，已经有了第三者，尽管这种第三者是同性的。因此，夫妻一方的同性恋行为导致了夫妻感情破裂，可以要求离婚。

根据2021年1月1日起施行的《民法典》第一千零四十三条
家庭应当树立优良家风,弘扬家庭美德,重视家庭文明建设。
夫妻应当互相忠实,互相尊重,互相关爱;家庭成员应当敬老爱幼,互相帮助,维护平等、和睦、文明的婚姻家庭关系。
